When is NGER report resubmission allowed?

An NGER report resubmission starts with the Clean Energy Regulator, not in EERS. A reporter that finds an error in a report it has already submitted must contact the Regulator and request a resubmission. EERS does not issue a submission receipt, and a report shows as submitted on the EERS reports page once the Submit button is pressed.

Key points

  1. Corrections start with a resubmission request to the Clean Energy Regulator
  2. Resubmission is accepted where a report is non-compliant
  3. Repeated resubmissions may lead to compliance action
  4. Supporting records are kept for five years

When the Regulator accepts a resubmission

The Regulator accepts resubmission requests only where a report is non-compliant. It has stated that repeated resubmissions, in one year or across several, may lead to compliance action against the reporter. Section 19 of the NGER Act, which sets the reporting obligation, is a civil penalty provision with a maximum of 2,000 penalty units, and the Regulator publishes the names of organisations that report late.

Audits

The Regulator can audit reported information under sections 73, 74 and 74A of the NGER Act, and participants pay for compliance audits it initiates. Where a reporter attaches a reasonable assurance audit by a Category 2 registered greenhouse and energy auditor to its report, the Regulator will not re-audit the same information.

Records behind a correction

Records supporting a correction are kept like any other NGER record: for five years from the end of the reporting year, in paper or electronic form that auditors can access. The Regulator recommends recording the methods and measurement criteria used and why they were chosen.

Published data

By 28 February each year the Regulator publishes a point-in-time extract of the data reported for the previous year.

Getting it right before submission

There is no provision for extensions to the reporting deadline, so errors are best caught before the report is submitted. EERS attachments can carry a basis of preparation report that explains the methods and assumptions behind the figures. The Regulator’s reporter support page lists common issues, such as liquid fuels entered in litres rather than kilolitres and negative net energy consumption values.
